Justiça decide a favor do Vasco em ação milionária contra a Champs

Por unanimidade, a 8a Câmara Cível do Tribunal de Justiça do Rio de Janeiro (TJRJ) acatou recurso do Vasco contra a Champs, ex-fornecedora de material esportivo do clube. A relatoria foi da desembargadora Norma Suely Fonseca Quintes. Pela sentença, a empresa deve pagar mais de R$ 3 milhões ao clube e o clube pagará nada a ela – diferentemente da decisão em primeira instância, que determinava que o clube deveria também pagar R$ 150 mil a empresa.

A ação é oriunda de 2009, com o Vasco pretendendo receber as parcelas mensais não satisfeitas pelo uso da imagem contratado, no valor de R$ 1.242.083,32, além da multa penal contratual no valor de R$ 2.000.000,00. Depois de prova pericial contábil, o juízo apurou saldo credor a favor do clube em R$ 1.718.734,95 e multa penal de R$ 2.785.963,48 para março de 2016.

A magistrada afirmou que o Vasco tem razão no pedido já que de acordo com o contrato firmado pelas partes, a atualização da multa penal deve ocorrer pelo Índice Geral de Preços do Mercado – IGP-M, da Fundação Getúlio Vargas. Para absolver o clube no pagamento para a Champs, a desembargadora afirmou que a fornecedora não teve a imagem afetada por conta de reprodução de matéria jornalística (leia íntegra da decisão abaixo).

A decisão cabe recurso para o próprio colegiado em segunda instância, em forma de embargos, e se considerado necessário, para instâncias superiores em Brasília.

Antes responsável pela área de marketing do Santos, o gerente executivo Marcelo Frazão é agora também o chefe da área de comunicação do clube. O anuncio foi feito pelo Alvinegro na manhã desta quinta-feira. No comunicado, é noticiado também o desligamento de Vinicius Lordello, então responsável pela área de comunicação do clube.

De acordo com a nota, o Santos está passando por um período de reformulação e organização estrutural e pretende retomar a unificação das áreas de comunicação e marketing nos próximos meses. Frazão é quem encabeçará o projeto.

Lordello foi, entre outras coisas, responsável pelo redimensionamento de gastos e operações da Comunicação, a implementação das transmissões ao vivo de todos os jogos das Sereias da Vila pela Santos TV quando mando do clube, a palestra pioneira de Walter Casagrande sobre prevenção ao uso de drogas para as categorias de base, além da inauguração do Portal da Transparência, iniciativa inédita na história do Clube e de vanguarda no futebol brasileiro.

Both teams have lost three players each. Heat are without Shane Watson (Rajasthan Royals), Mitchell Johnson (Mumbai Indians) and Thisara Perera (Sunrisers Hyderabad), while T&T have lost Kieron Pollard (Mumbai), Dwayne Bravo (Chennai Super Kings) and Kevon Cooper (Royals).The difference between the sides, however, lies in the other players Heat are missing. Luke Pomersbach is unavailable due to family reasons, and Daniel Vettori and Ryan Harris are out with injuries.T&T have been consistent over the years, qualifying for the CLT20 for the fourth time. They performed best in 2009, when they had Bravo and Pollard and made the final, but even without the pair T&T have six players who were part of the West Indies squad that won the 2012 World Twenty20 in Sri Lanka.Without Watson and Pomersbach, however, Heat will face a strong T&T bowling attack, and they might struggle to counter the spin of Samuel Badree, Sunil Narine and Sherwin Ganga on Indian surfaces. Chris Gayle, the captain of the Jamaica Tallawahs, credited allrounder Andre Russell for being the pivotal factor in his side’s title win on Saturday. Jamaica beat Guyana Amazon Warriors by seven wickets to win the inaugural Caribbean Premier League.”Russell has been fantastic throughout,” Gayle said. “He has been working on his striking and he comes through for us almost every time. I really hope he’s in the next West Indies squad.”Gayle, who won the Man-of-the-Match award for his enterprising 47 not out off 48 balls, praised his team’s commitment en route to the seven-wicket win in the final. After the match, Gayle revealed that Guyana’s strength while chasing totals had prompted him to field after winning the toss.”We are happy to actually be the champions. The management has been great and the players played their parts well. We’re a professional unit and played some good cricket,” Gayle said. “Guyana likes to chase so I think we wanted to restrict them early after winning the toss. We wanted to put them under early pressure. They have quality bowlers but our bowlers and batting maintained a high standard throughout and into the final. Sangakkara was very crucial as well as Danza (Hyatt) when we needed them to be and it’s a great team effort.”Gayle also specified his plan of action in his innings: “I said I was going to bat all 20 overs. I rather stay there until the end. I did not plan to give it away today. I wanted that so badly and I had to stay there and guys rally around me and it was really, really good.” Gayle was also adamant about how the team dispelled false truths about being a composition of Test players. “A lot of talks have been around from the start of the tournament when we picked our team. A lot of people said it was Test team but (we showed that) a Test team can actually win T20 tournaments as well.There were rumours about Gayle’s performances of late being attributed to weaker vision, but Gayle put those to rest: “People said my eyesight was gone as well and that I was not seeing the ball so a lot of things have been going on from a personal point of view so I am really happy that it is over now. I am finished with cricket for another three months,” said Gayle.Gayle was also happy that the victory had helped him address his critics: “I am happy I batted through the innings, and as captain, because this was the most important CPL match we played. I did want to silence my critics and I believe I did!”Guyana skipper Ramnaresh Sarwan, said that changes to the batting line-up had not worked for the side in this game. Offspinner Sunil Narine was sent ahead of James Franklin and Sarwan with nearly five overs to go, and the move may have cost Guyana a few crucial runs towards the end.”I take full responsibility. The (batting) adjustments didn’t pay off. We couldn’t get momentum and my mistakes cost us the game,” Sarwan said. “I live by my decisions. We played well and I think we played the best cricket prior to this out of all the teams but while we worked really hard, we lost it at the end.”Sarwan praised seamer Krishmar Santokie for his performance during the tournament. Santokie finished the tournament with 16 wickets, the most for any bowler in the CPL and Curtly Ambrose, Guyana’s assistant coach, said te seamer was “a key player that West Indies should focus on having in their team”.

اعترف جناح منتخب الأرجنتين، آنخل دي ماريا، بأن اللعب بجوار مواطنه، ليونيل ميسي، هو أفضل شيء حدث له في مسيرته الكروية.

ولعب دي ماريا مع ميسي مع منتخب الأرجنتين لسنوات ونجحا في الحصول على كأس العالم قطر 2022 وكوبا أمريكا 2021، بالإضافة إلى مزاملتهما لمدة موسم مع باريس سان جيرمان في موسم 2021/2022.

وتحدث دي ماريا عن مزاملة ميسي في حواره عبر شبكة “ESPN”، وقال: “أفضل شيء حدث في مسيرتي هو أنني لعبت مع ليو في المنتخب وباريس سان جيرمان”.

وتابع: “تزاملنا سويًا في باريس سان جيرمان لمدة موسم، لم أكن ألعب كثيرًا، لكنني توقعت ذلك، عندما يأتي ميسي لنا فلن ألعب كثيرًا، أخبرت زوجتي وباريديس أنني لن ألعب بعد الآن”.

وأضاف: “لكن أن أكون معه لمدة موسم وأتدرب معه كل يوم هو أفضل شيء يحدث لي، أعتقد أن هذا هو أهم شيء”.

وعن نهائي كأس العالم 2022 أمام فرنسا: “عندما أرتدي قميصي، عادة ما أبدأ بالصلاة، لدي صليبي وهاتفي مع صورة زوجتي مع بناتي، كنت دائمًا ما أشعل شمعة، لكن قبل تلك المباراة لم أفعل ذلك، لكنني شكرت الله على اللحظة التي كنت سأعيشها في النهائي، اللحظة التي أردتها وانتظرت من أجلها 8 سنوات، كانت في يدي لألعب نهائي المونديال”.

وواصل تصريحاته: “أردت أن أحظى بتكريم هائل وتصفيق رائع من ملعب يعج بالجماهير في الأرجنتين، لقد تغير كل شيء في هذا اليوم، لقد أسعدني أن الجماهير سعيدة بما حققناه، لقد جلبنا الفرحة والسعادة للبلد وسأظل أتذكر ذلك طيلة عمري”.

واستمر: “لقد علمت ابني بعد ما تحقق أنه يظل يؤمن، يحلم ولا يستسلم حتى يحقق كل أحلامه، هذا لا يقدر بثمن، لقد كانت واحدة من أجمل الأشياء التي كان بإمكاني تركها في مسيرتي”.

وأتم: “لقد فعلت كل شيء لأمثل منتخب الأرجنتين طوال مشواري الكروي، أحب التواجد في المنتخب كما هو الحال مع حديقة منزلي”.

The win was Lancashire’s third in six games and it boosts their hopes ofqualifying the quarter-finals from the North Group.The home side’s innings was dominated by a knock of 74 by opener Stephen Moorewhose 42-ball innings included five sixes and five fours. Moore was particularly hard on David Wainwright, taking 23 runsoff the slow left-armer’s third over. OverviewThere are many reasons why West Indies could be the most dangerous team in the tournament. Their strongest attribute is that they possess more than one matchwinner: Chris Gayle, Marlon Samuels, Kieron Pollard and Kemar Roach have the capability to overpower opposition. Sunil Narine plays a decisive role, especially during the final fifteen overs, including the batting Powerplay, when batsmen step on the accelerator.Their determination to hang in there to win the ICC World Twenty20 in Sri Lanka last year, where they lived on the edge on a few occasions, would have given them the self belief needed in big tournaments. However the challenge now is whether they can repeat that in England. They could certainly take solace in The Oval Miracle, where they fought back from 147 for 8, chasing England’s 218, and ended up winning by two wickets in near twilight. That event was hosted in England as well, so West Indies can draw upon that memory for inspiration.For them to win, the Big Five will have to stand up and lead. Gayle has said he wants to play deep into the innings. Samuels, one of Wisden’s top five cricketers of 2013, will be the pivot between the top and lower order, and can also squeeze in a few overs as a spinner. Pollard needs to bring his world-class finishing skills, so effective in Twenty20 cricket, and perform on a consistent basis.But the two people who can influence the team’s belief will be the former and current captains: Dwayne Bravo and Darren Sammy. Bravo took over the ODI leadership from Sammy prior to this tournament, and has the respect of his players being the fourth senior-most member behind Gayle, Ramnaresh Sarwan and Samuels. More than his allround skills, it would be his leadership style that would determine the Windies approach. But unlike Sammy’s animated approach, Bravo can be isolated at times. He needs to confide in Sammy when in a tight corner, and be flexible in changing plans whenever the going gets tough.Key playerDespite his success in the Twenty20 format, Kieron Pollard has never managed to bring the matchwinner status he has established in tournaments like the IPL. However, his potential cannot be questioned. He has been West Indies’ best ODI batsman since the 2011-12 season where he has scored 926 runs from 30 innings with three centuries (most by a West Indies batsman during this period). Pollard has the firepower to demolish the best bowling attack during the death overs and it will be in the role of finisher where he can help swing West Indies’ fortunes. Pollard performed that role to perfection in Mumbai Indians winning their maiden IPL title last month. Pollard scored 250 runs in the last five overs, second only to MS Dhoni (286). Pollard’s strike-rate was 10.06 runs an over in these overs, as he finished as the second best finisher in terms of runs. He hit 20 sixes in the last five overs of this IPL, most by any batsman, along with Rohit Sharma.Surprise packageAt 6’8″ tall, Jason Holder is the youngest in the Windies squad. But he resembles the famous breed of fast bowlers from the glory days of Caribbean cricket, when tall and gangly men could hit that unplayable length effortlessly, playing truant with the best batsmen. Holder’s List A record is impressive with 29 wickets in 16 innings at an average of 20.24 and an economy-rate of 4.47. With his medium pace, and the bounce he can generate because of his stature, Holder could be a handy option, especially in the middle overs, a vital segment in ODIs where good batting teams gain the initiative.WeaknessDiscipline and playing as a group. As they showed in their first warm-up match against Australia, the players can easily forget their plans. Initially Johnson Charles started aggressively, but failed to switch gears as the Australian bowlers found a rhythm. Luckily Darren Bravo played a mature innings to raise a platform for a 300-plus target, but the Windies batsmen panicked in their attempt to accelerate during the batting Powerplay, thereby finishing easily 30 runs short.
